Adult Children Try to Sue Mother for Being a Bad Parent

Kids sue mom for being bad mother

Citing evidence such as birthday cards that contained no money and a lack of care packages when they were away at college, Steven Miner, 23, and Kathryn Miner, 20, tried to sue the woman who brought them into the world for being “negligent” and causing them “emotional distress.”

However, an Illinois appeals court dismissed the $50,000 suit last week, ruling that Kimberly Garrity’s behavior toward her children wasn’t ”extreme or outrageous.”

This siblings’ lawyer in their case was their father, who (surprise, surprise) Garrity divorced in 1995. In court papers, the Miners claim that their lawsuit wasn’t an attack on mom, but rather an attempt to make her ”accountable” for behavior like not buying her daughter a homecoming dress, which was also presented as evidence of her negligence.

In dismissing the case, the appeals wrote that allowing it to go forward “could potentially open the floodgates to subject family child rearing to … excessive judicial scrutiny and interference.”
